Terms of Service

These terms are an agreement between your organisation and CharityOS ("we", "us"), the operator of Givio — a customer relationship management platform built for charities and non-profit organisations. By creating an account or using Givio, you agree to these terms on behalf of your organisation. If you do not agree, please do not use the service.

1. Your account

To use Givio you register an organisation account and invite team members to it. You are responsible for keeping login credentials secure, for the accuracy of the information you provide about your organisation, and for the actions of everyone who uses Givio under your account. You must be authorised to act on behalf of the charity you register.

2. Free trial

Every new account starts with a 14-day free trial. No payment card is required, and all features are unlocked for the duration of the trial so you can properly evaluate the platform.

When your trial ends, one of two things happens:

  • You subscribe — your account continues without interruption and all your data stays exactly where it is.
  • You do nothing — your account is paused. You will not be able to sign in to use the platform, but your data is kept safely for 90 days. Subscribe at any point during those 90 days and everything is restored instantly. After the 90 days — and after we have sent you a final warning email — your account and all its data are permanently deleted.

3. Subscriptions and billing

Paid plans are billed through Stripe, our payment provider, either monthly or annually depending on the billing period you choose. Prices are shown on our pricing page and exclude VAT where applicable.

  • Your subscription renews automatically at the end of each billing period unless you cancel.
  • You can cancel at any time through the Stripe customer portal, which is linked from your account's billing settings. No phone calls, no forms.
  • When you cancel, you keep full access until the end of the billing period you have already paid for. After that, your account is paused and the same 90-day data retention period described above applies.
  • If a renewal payment fails, we will retry it and email you. If payment cannot be collected, the account is paused in the same way.

4. Your data

The donor, volunteer, and fundraising data you store in Givio belongs to your organisation. You are the data controller of it; we process it only on your instructions, as set out in our Data Processing Agreement. Our Privacy Policy explains how we handle personal data more generally.

5. Acceptable use

You agree not to use Givio to:

  • break the law, including data protection, fundraising, and anti-money-laundering law;
  • send spam or unsolicited communications to people who have not consented to receive them;
  • store or distribute unlawful, harmful, or infringing content;
  • attempt to gain access to another organisation's data or to any part of the platform you are not authorised to use;
  • probe, scan, overload, or otherwise interfere with the security or availability of the service; or
  • resell or sublicense access to Givio without our written agreement.

We may suspend an account that we reasonably believe breaches these rules. Where practical we will contact you first and give you a chance to put things right.

6. Service availability

We work hard to keep Givio available around the clock, and we take backups and resilience seriously. However, no online service can promise uninterrupted availability. Givio is provided "as is" and we do not guarantee that it will be error-free or available at all times. We may occasionally take the platform offline for planned maintenance; where possible we will give advance notice and schedule it outside UK working hours.

7. Limitation of liability

Nothing in these terms excludes or limits liability that cannot be excluded or limited under the law of England and Wales, including liability for death or personal injury caused by negligence, or for fraud.

Subject to that:

  • we are not liable for indirect or consequential losses, loss of profits, loss of donations or fundraising income, or loss of goodwill; and
  • our total liability to you arising out of or in connection with the service in any 12-month period is limited to the amount you paid us for the service in that period.

You remain responsible for your own compliance obligations as a charity — including Gift Aid claims to HMRC, Charity Commission reporting, and your obligations to your donors. Givio provides tools to help with these; it does not provide legal, tax, or accounting advice.

8. Changes to the service and these terms

We improve Givio continuously and may add, change, or retire features. If we make a material change to these terms, we will email the account owner at least 30 days before it takes effect. Continuing to use the service after that date means you accept the updated terms.

9. Governing law

These terms, and any dispute arising out of them or the service, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
